Terms of Use

1. Acceptance

By using Axium Labs, submitting a request for access, joining an Axium Discord channel, or receiving Axium alerts, you agree to these Terms. If you do not agree, do not use the service.

Axium may update these Terms from time to time. The updated version applies when posted, unless a different effective date is stated.

2. The Service

Axium Labs provides generalized options trade alerts, market commentary, sentiment reports, and related educational materials. Alerts may include entries, exits, stops, Axium Position Manager updates, and end-of-day summaries.

Axium does not open brokerage accounts, hold customer funds, execute trades for members, or provide individualized portfolio management. You are responsible for deciding whether any alert is suitable for you and for entering, managing, or closing any trade in your own account.

3. No Personalized Advice

The service is not personalized investment, legal, accounting, tax, or financial planning advice. Alerts and commentary are not tailored to your objectives, account size, risk tolerance, liquidity needs, tax situation, or trading experience.

You should consult qualified professionals before making financial decisions. You should also confirm whether you may legally use the service in your jurisdiction.

4. Eligibility and Account Responsibility

You must be legally able to enter into these Terms and use the service. You are responsible for keeping your account, Discord access, and any credentials secure. You may not share paid access, resell alerts, redistribute content, or use the service for unlawful activity.

5. Subscriptions, Billing, and Access

Plan features, prices, seat limits, promotions, and access rules may change. If paid billing is enabled, the checkout or invoice terms shown at purchase govern billing frequency, renewal, cancellation, taxes, and refunds.

Axium may approve, deny, suspend, or terminate access where needed to protect the service, enforce these Terms, comply with law, or address misuse.

6. Third-Party Services

The service may rely on third-party platforms and data providers, including Discord, Cloudflare, payment processors, email providers, market-data vendors, and sentiment or research providers such as Unusual Whales. Those services are governed by their own terms and privacy practices.

Third-party outages, data delays, data errors, rate limits, or delivery issues may affect alerts, reports, access, or form submissions.

7. Performance Information

Any performance figures, Axium Position Manager replay results, win rates, profit factors, P&L, drawdowns, examples, testimonials, or screenshots are for informational purposes only. Unless expressly stated in writing, they are internal system-analysis illustrations.

Simulated, replayed, optimized, or hypothetical results have important limitations. They may not reflect liquidity, slippage, commissions, taxes, rejected orders, execution delays, partial fills, platform outages, psychological factors, or live market conditions. Past performance does not guarantee future results.

8. Intellectual Property

Axium names, logos, website design, alert formats, research notes, data presentations, software, and other materials are owned by Axium Labs or its licensors. You receive a limited, revocable, non-transferable right to use the service for your personal use only.

9. Disclaimers

The service is provided "as is" and "as available." Axium does not promise uninterrupted access, error-free alerts, complete data, profitable trades, or that any alert will be received before a market move occurs.

Options trading is risky and may result in the loss of all capital allocated to a trade. Review the Risk Disclosure before using the service.

10. Limitation of Liability

To the fullest extent permitted by law, Axium Labs and its owners, operators, contractors, and service providers will not be liable for trading losses, lost profits, lost opportunities, data errors, delivery delays, service interruptions, or indirect, incidental, consequential, special, exemplary, or punitive damages arising from the service.

11. Indemnity

You agree to defend and indemnify Axium Labs from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your trading decisions, your breach of these Terms, or your misuse of Axium content.

12. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-law rules. Courts located in Ontario will have exclusive jurisdiction unless applicable law requires otherwise.
